Privacy Policy and Cookies

This text is a translation of the original Privacy Policy and Cookies page in Ukrainian. Both versions have the same legal force. In case of any discrepancies in the texts, the Ukrainian version will prevail.

The Public Organization “UNITED FORCES OF AUTO VOLUNTEERS” (hereinafter referred to as the “Organization”) is committed to ensuring the security of your data. This Privacy Policy and Cookies (hereinafter referred to as the “Policy”) has been drafted to reassure you about what happens to your personal data that you provide to us for registration. This Privacy Policy describes the types of personal information we receive from visitors to the website https://osahelp.com.ua (hereinafter referred to as the “Site”), and how we collect, process, and use this information.

This Policy applies only to information collected on the Site, and the Organization is not responsible for the privacy policies or content of third-party websites.

Information and personal data are collected, processed, and used in strict accordance with the requirements of current Ukrainian legislation and the European Parliament Bureau’s decision on the implementation rules concerning Regulation (EU) 2018/1725 of the European Parliament and of the Council on the protection of natural persons regarding the processing of personal data by Union institutions, bodies, offices, and agencies, as well as on the free movement of such data (2019/C 259/02).

By registering on the Site, you also confirm that you have familiarized yourself with the list of your rights as a data subject under Article 8 of the Law of Ukraine “On Personal Data Protection.” This list is available at the following link: http://zakon2.rada.gov.ua/laws/show/2297-17.

Your provision of information on the Site indicates your consent to this Policy and means that you grant the Organization permission to collect, use, and disclose/disseminate information that identifies you in accordance with this Privacy Policy. If you do not agree with the terms of this Privacy Policy, DO NOT send us any information and immediately discontinue using the Site.

1. TERMS AND DEFINITIONS

1.1. Privacy Policy – A digital agreement with an unlimited number of Site users. The Privacy Policy obtains the user’s unconditional consent for the collection, processing, storage, and transfer of personal data. The Privacy Policy also informs users about the purpose of collecting personal data and other important points that follow the requirements of national legislation of different countries and documents similar to GDPR and CCPA.

1.2. Site – The Organization’s website on the Internet at https://osahelp.com.ua, containing text, graphics, and other information perceived as a single entity, supported by a system software complex.

1.3. Site Owner (hereinafter referred to as the “Owner”) – The public organization “UNITED AUTO VOLUNTEERS,” which is the owner and controller (processor) of the Users’ personal data.

1.4. User – Any individual who has ever accessed the Site and is of an age permissible for accepting this Policy.

1.5. Personal Data – Any information relating to an identified or identifiable natural person, including through the Site. This includes, but is not limited to, the name, date of birth, geolocation data, contact details, a set of other information about the person (age, gender, email address, etc.).

1.6. Cookie File – A file containing an identifier (a string of letters and numbers) that a web server sends to a web browser and is stored by the browser. The identifier is then sent back to the server each time the browser requests a page from the server. Cookies are typically used to ensure the functioning of the Site or to enhance its efficiency, as well as to provide analytical information about users. Other technologies, such as unique identifiers that help identify a web browser, application, or device, pixels, and local storage, may also be used for this purpose. When you visit the Site, we send one or more cookies to your computer or other device.

Cookies can be either “persistent” or “session” cookies: a persistent cookie is stored by a web browser and remains valid until its set expiration date unless deleted by you before the expiration date; a session cookie, on the other hand, expires at the end of your session when the web browser is closed. Cookies generally do not contain any information that personally identifies you, but personal information that we store about you may be linked to information stored and retrieved from cookies.

1.7. Site Services – Any actions and goods offered on the Owner’s site aimed at non-profit activities for the implementation of the Owner’s social and charitable projects.

2. COLLECTION AND USE OF PERSONAL DATA

2.1. The use of the Site does not require registration and/or authorization and does not require the direct provision of personal data that can identify you, except as provided in this Policy.

2.2. The Organization collects only personal data that is consciously and voluntarily provided by you as a data subject for the purpose of using the Site’s services, which, in accordance with the requirements of current Ukrainian legislation, constitutes the data subject’s consent to the processing of their personal data in accordance with the purpose of processing defined in this Policy.

2.3. The Organization may collect information that allows your identification when you choose to interact with us and provide relevant information via feedback forms or registration forms posted or that may be posted on the Site, or otherwise provide this information through the Site, including by sending requests, etc. Personal data may include, among other things, information about your name, phone number, residential address, email address, document details, and other similar information.

2.4. At your discretion, you may purchase goods displayed on the Site, the proceeds of which go towards the implementation of social and charitable projects. If you purchase goods/services, the Organization will request the following information from you: full name, phone number, email address, delivery address, and/or your residential address.

2.5. We may collect, store, and use the following types of your personal data: 

2.5.3. Information you provide as specified in paragraphs 2.3.-2.4. of this Policy; 

2.5.4. Information generated while using the Site, including when, how often, and under what circumstances you use it; 

2.5.5. Information related to voluntary (charitable) donations made on the Site, including name, address, phone number, email address, and credit card details; 

2.5.6. Information contained in any communications you send us via email or through the Site, including its content and metadata; 

2.5.7. Any other personal information you send us using the Site.

2.6. When you visit the Site, certain data is automatically recorded on the Organization’s servers for system administration, as well as for statistical or backup purposes, using a number of technologies, including but not limited to cookies, tags, IP address tracking/URL tracking, and other tools. 

The recorded information may include: 

– Information about your computer, including IP address, the name of your internet service provider, geographic location, type, and version of the browser, and operating system;

– Information about your visits and use of the Site, including the source that brought you to the Site, duration of visits, page views, navigation paths on the Site, and the amount of time you spent on the Site; 

– The addresses of websites you visit simultaneously with our Site and, if possible, your search parameters that led you to the Site.

2.7. The Organization guarantees that it will not transfer your personal data to third parties or use it in any other illegal manner, except when the disclosure of your personal data is necessary to comply with the requirements of current Ukrainian legislation.

2.8. The Organization does not collect or process your personal data regarding racial or ethnic origin, political, religious, or philosophical beliefs, membership in political parties and trade unions, criminal convictions, as well as data related to health, sexual life, biometric or genetic data (in accordance with Article 7 of the Law of Ukraine “On Personal Data Protection”).

3. PROCESSING OF PERSONAL DATA

3.1. The processing of the User’s personal data is carried out without any time limitation and by any legal means, including in personal data information systems with or without the use of automated tools. 

3.2. The Website Owner takes the necessary organizational and technical measures to protect the User’s personal information from unauthorized or accidental access, destruction, alteration, blocking, copying, distribution, as well as from other unlawful actions by third parties.

4. USE OF PERSONAL DATA

4.1. Your personal data is used only for the purpose for which you provide it. 

4.2. The Public Organization may use your personal data for the following purposes: 

– Administration of the Website and conducting social and public activities; 

– Supporting and organizing feedback with you; 

– Internal marketing, sending promotional materials and delivering emails, including through postal mailings and SMS. You can opt out of receiving such communications at any time by responding to a promotional email or by contacting us at osavolunteer@gmail.com; 

– Enabling the purchase of products available on the Website; 

– Enabling donations to our social and charitable projects; 

– Maintaining our databases, including contact databases, for statistical, sociological, and other research purposes; 

– Keeping the Website secure and preventing fraud; 

– Verifying compliance with the terms that govern the use of the Website (including monitoring private messages sent through the Website’s private messaging service). 

4.3. The Public Organization will not, without your explicit consent, provide your personal information to any third party for their direct marketing or any other purposes, except as required by applicable Ukrainian law.

5. STORAGE AND PROTECTION OF PERSONAL DATA

5.1. The processing and storage of the provided personal data are carried out in data centers where the equipment that ensures the operation of the Website’s services is located. The provided personal data is processed and may be stored in the personal data database or a separate table of the Website’s database. 

5.2. Personal data is stored for no longer than necessary for the purpose of its processing. 

5.3. The Public Organization uses generally accepted standards of technological and operational information security to protect personal data from loss, misuse, or unauthorized alteration (encryption, integrity, and ongoing confidentiality, ability to timely restore access, effectiveness testing). However, no method of transmitting information over the Internet or mobile communication, or method of electronic storage, is 100% secure. Despite our efforts, we cannot guarantee or ensure the security of any information you transmit to us through the Website. 

5.4. You acknowledge that you understand the risks described above, including the possibility that the information you provide may be lost or accessed by third parties, and you personally and independently assume all risks associated with this.

6. INTERACTION OF THE OWNER WITH THIRD PARTIES REGARDING PERSONAL DATA

6.1. The Public Organization does not provide access to your personal data to third parties, except in the following limited circumstances: 

6.1.1. We have your permission. We require your explicit consent to share any confidential information. 

6.1.2. We have sufficient grounds to believe that access, use, storage, or disclosure of such information is necessary for: 

– Compliance with Ukrainian law, including providing information upon the request of individuals and legal entities, institutions, organizations of any form of ownership, or state bodies that have the right to receive such information under Ukrainian law; 

– Investigating potential violations of the Public Offer, which includes providing information about you in response to a properly formatted attorney’s request with information about the violation; 

– Detecting and preventing fraudulent activities, resolving security issues, and eliminating technical malfunctions; 

– Protecting against immediate threats to the rights, property, or safety of the Public Organization, its users, or the public, within the framework of Ukrainian law. 

6.2. Access to your personal data may be granted to our authorized employees who have agreed to maintain the confidentiality of the Users’ personal data, as well as to third parties who provide us with support and administration services for the Website, and other services related to the Owner’s non-profit activities. Our authorized employees and/or third parties, based on contracts concluded with us, are required to comply with all requirements of current Ukrainian legislation regarding the protection of Users’ personal data and its confidentiality.

7. CONDITIONS FOR ACCESS TO PERSONAL DATA

7.1. The Public Organization makes every effort to provide you with access to your personal data and either correct it if it is inaccurate or delete it at your request, unless its retention is required by law or justified by legitimate business purposes. Before processing requests, we ask users to confirm their identity by providing their full name, place of residence, and details of the identity document, as well as the information they wish to access, correct, or delete. 7.2. Access to your personal data is provided free of charge. Delays in accessing your personal data are not permitted. Delays in access to personal data by third parties are allowed if the necessary data cannot be provided within thirty calendar days from the date the request is received. However, the total time for resolving issues raised in the request cannot exceed forty-five calendar days. 

7.3. Notification of the delay is provided to the third party who submitted the request, in writing, with an explanation of the procedure for appealing such a decision. 

7.4. Refusal to access personal data is allowed in the manner prescribed by current Ukrainian legislation if access to it is prohibited under the Law of Ukraine “On the Protection of Personal Data.” 

7.5. A decision to delay or refuse access to personal data may be appealed to the relevant authorized bodies.

8. RIGHTS OF THE DATA SUBJECT

8.1. The User (data subject) has the right to: 

– Know the sources of collection, the location of their personal data, the purpose of its processing, the location of the Owner, or give the appropriate authorization to obtain this information to authorized persons, except in cases provided by the Law of Ukraine “On the Protection of Personal Data”; 

– Receive information about the conditions of access to personal data, including information about third parties to whom their personal data is transferred; 

– Access their personal data; 

– Receive, no later than thirty calendar days from the date of the request, except in cases provided by the Law of Ukraine “On the Protection of Personal Data,” a response as to whether their personal data is being processed, as well as receive the content of such personal data; 

– Submit a reasoned request to the Owner objecting to the processing of their personal data; 

– Submit a reasoned request for the modification or destruction of their personal data by the Owner if this data is processed unlawfully or is inaccurate; 

– Protect their personal data from unlawful processing and accidental loss, destruction, damage in connection with intentional concealment, failure to provide or delay in providing it, as well as protection from providing information that is inaccurate or defames your honor, dignity, and business reputation; 

– File complaints regarding the processing of their personal data with the Commissioner of the Verkhovna Rada of Ukraine for Human Rights or with the court; 

– Exercise legal remedies in case of violation of the current Ukrainian legislation on the protection of personal data; 

– Make reservations regarding the restriction of the right to process their personal data when giving consent; 

– Withdraw consent to the processing of personal data; 

– Know the mechanism of automatic processing of personal data; 

– Protect themselves from an automated decision that has legal consequences for them.

To update, access, amend, block, or delete your personal data, withdraw consent to the processing of personal data that you have provided under this Policy, or if you have any comments, suggestions, or complaints regarding your personal data being processed by the Public Organization, please contact us via email at osavolunteer@gmail.com.

9. COOKIES

9.1. The Website uses cookies.

9.2. The Public Organization uses several types of cookies to ensure the proper functioning of the Website. This helps the Public Organization improve your experience while browsing the Website and analyze the Website’s traffic. The Public Organization also uses cookies and similar technologies to determine the success of advertising campaigns and gather information about your behavior on the Website.

9.3. The Public Organization uses the following categories of cookies:

9.3.1. Strictly necessary cookies – essential for navigating the webpage, performing searches on the Website, and remembering previous actions of the user when moving to the previous page in the same session.

9.3.2. Functional cookies – used to save settings or configurations stored on the user’s device between web browser sessions. These cookies also allow users to watch videos, participate in interactive activities (polls, voting), and interact with social networks. To enhance the experience after visiting the resource, these cookies remember the information provided by the user, improving the interaction with the Website.

9.3.3. Analytical cookies – used to enable the analysis of main web traffic. These cookies help us obtain information about the number of Website visitors, whether the visitor has previously visited the Website, the time, duration of the visit, and the way the Website was accessed. For this purpose, the Public Organization uses Google Analytics and ensures compliance with the strictest privacy settings. Cookies are deleted within 2 years. 9.3.4. Advertising cookies – The Public Organization uses Google Ads to track whether you accessed the Website through an advertisement placed by the Public Organization on a Google search results page. These cookies allow the Public Organization to obtain information about your location, time of day, and the device you used to access the Website. Google may determine the success of the campaign using conversion tracking tags placed on the Website. These cookies expire after 3 months. Google may use various cookies to track how you accessed the Website, depending on the advertisement you clicked on that directed you to the Website. 9.4. Most browsers allow you to refuse to accept cookies. You have the right to decide whether to accept or reject the use of cookies. You can also set your browser to automatically delete, disable, or block cookies. Even if you choose to refuse cookies, you can still use the Website, but your access to some of its features and sections may be limited.

9.5. Information about users obtained through cookies is not sold or publicly distributed. 

9.6. This Policy applies only to the Website. To deliver content more efficiently, display it better, and perform detailed analysis on the Website, the Public Organization uses services owned by third-party companies, which may use cookies on the user’s device while working on the Website. It should be noted that the Website cannot influence the operation of cookies used by other services. If you click on a link to another information resource, you should review their cookie policy.

10.2. In the event of significant changes to this Policy, a notice will be posted on the Website specifying the effective date of these changes. If within the specified period, you do not refuse to accept them in writing, it will mean that you agree with the respective changes to the Policy. We recommend that you periodically review the Policy to stay informed of any changes or additions.
